3 STRIKES MISTRIAL; CLIENT FREED

A mistrial (hung jury) on a 3-strikes, life in prison, sex case where, after two years in custody awaiting trial, indigent defendant was freed from jail, regaining his liberty. (San Mateo County)

 

DOMESTIC VIOLENCE & ASSAULT DISMISSALS

Numerous dismissals or charge reductions at trial or before on DV and assault cases including the following cases:

 

FELONY ASSAULT DISMISSED AT TRIAL

– Felony assault case dismissed at trial where defendant, a delivery truck driver, in self-defense, stabbed alleged victim in the face w/ a pen. Investigation and nearby security video showed the alleged victim to actually be the aggressor and instigator. (San Mateo County)

 

MISDEMEANOR DOMESTIC VIOLENCE REDUCED AT TRIAL

– Misdemeanor DV reduced at trial to a PC415, disturbing the peace, w/ no jail time where female defendant stabbed boyfriend in the face w/ a key. (San Mateo County)

 

MULTIPLE FELONY ASSAULT CHARGES AGAINST JUVENILE DISMISSED

– Multiple felony assault charges and case dismissed following a dispositional hearing of a juvenile accused of assaulting three adult relatives. (Contra Costa County) 

 

FISH & GAME CONVICTION DISMISSED

Rare granting of a Coram Nobis motion and dismissal of a misdemeanor Fish & Game violation conviction enabling a commercial fisherman to keep his fishing license and continue his livelihood after the Fish & Game had attempted to suspend that license based on the conviction. FELONY EMBEZZLEMENT CHARGE REDUCED TO MISDEMEANOR

No jail time and reduction from felony to misdemeanor on an approximately $15,000 embezzlement of a non-profit shelter for youth by a local police officer. (San Francisco County)

 

FELONY ASSSAULT ON OFFICER DISMISSED

Dismissal of felony assault on an officer where defense investigation uncovered a history of racial animus on the part of the officer. (Solano County)

 

FELONY EVADING AN OFFICER DISMISSED

Dismissal on a felony where client was arrested and charged with allegedly evading the police in a vehicle chase where defense investigation uncovered the real perpetrator of the crime, the defendant’s father. (San Mateo County)

 

FELONY ASSAULT CHARGES IN DRIVE-BY SHOOTING DISMISSED IN JUVENILE CASE

Release and dismissal of felony charges after 4 months in custody of a 15-year-old juvenile involved in a felony drive-by shooting where the prosecution wanted defense client to stay incarcerated until the age of 25. That client went on to graduate from UC Santa Cruz and is now a high school teacher. (Alameda County)

 

DUI FELONY VEHICULAR MANSLAUGHTER CHARGES REDUCED ON CLIENT FACING 15 YEARS IN PRISON

One year served in the county jail (on 2-year prison term) on a felony case where client was charged w/ DUI vehicular manslaughter w/ gross negligence and a fleeing the scene enhancement (facing 15 yrs. in prison) where charge reduced at trial to vehicular manslaughter w/o gross negligence (allowing client to keep his driver’s license for employment) and dismissal of enhancement. (Colusa County)

 

ACQUITTAL ON MISDEMEANOR ASSAULT

Acquittal at trial on an assault and battery charge, stemming from a barroom fight, where the defendant, in self-defense, smashed a glass into the face of the alleged victim, causing a severe facial injury. (San Mateo County)

 

FELONY EMBEZZLEMENT DISMISSED

Granting of counsel’s Serna motion and the dismissal of defendant’s felony embezzlement (over $20,000) charges. (Marin County)

 

DUI REDUCED TO WET RECKLESS ON BAC OVER .15 WITH AN ACCIDENT

Negotiated a reduction from a misdemeanor DUI w/ BAC over.15, and where defendant flipped vehicle in a single car accident, to a “wet reckless” for a young military officer whose career would have been in jeopardy if convicted of standard DUI. (Napa County)

 

IMMIGRATION SAFE DISPOSITIONS:

Numerous immigration safe reduced dispositions for clients charged w/ a felony, a DUI or crimes of moral turpitude or violence and facing deportation if convicted of a felony, a DUI, or a crime of moral turpitude or violence, including the following cases:

 

POTENTIAL 2ND DUI CONVICTION REDUCED TO WET RECKLESS

-Negotiated a reduction of a misdemeanor DUI, a potential second conviction of moral turpitude, to a “dry reckless” for a 25-year-old undocumented defendant. (Santa Clara County)

FELONY CHARGE OF THROWING A DANGEROUS OBJECT FROM VEHICLE REDUCED TO MISDEMEANOR; CLIENT AVOIDS ICE CUSTODY

-Negotiated a reduction from original felony VC 23110(b), in this case shooting a BB gun at a moving vehicle on the freeway, to an immigration safe misdemeanor PC 594, vandalism, for 21-year-old undocumented defendant raised in US but born in Chile. Case was also noteworthy in that, following the plea and sentence, we successfully squired the defendant out of jail, just avoiding ICE officers intent on picking him up at the conclusion of the case. FELONY CONSPIRACY CHARGE REDUCED TO MISDEMEANOR; STRIKE DISMISSED; CLIENT AVOIDS ICE CUSTODY

Negotiated a reduction from a felony PC 182, conspiracy, w/ a strike and possible prison to a misdemeanor PC182 w/ 29 days on sheriff’s work program (30 days was automatic jail time thus subjecting defendant to ICE pick-up) for a young undocumented man. (Marin County) 

 

FELONY DRUG POSSESSION FOR SALE DISMISSED

Dismissal following a successful 1538.5 motion where defendant was charged w/ a felony possession for sale of cocaine. (San Francisco County)

 

FELONY DRUG POSSESSION FOR SALE DISMISSED

Dismissal following a successful Serna motion where defendant had been arrested returning from Mexico on a warrant for felony possession for sale of a controlled substance approximately two years after the case was originally filed. (San Mateo County)

 

DRUG & FIREARM CHARGES DISMISSED

Dismissal following a successful 1538.5 motion where defendant was charged w misdemeanor possession of drugs and carrying a concealed firearm in a vehicle. (San Mateo County)

 

FELONY CHARGE OF STOLEN VEHICLE DISMISSED

Dismissal of a felony driving a stolen vehicle after defense investigation obtained statement from alleged victim admitting false accusation. (Alameda County)

 

ROMERO MOTIONS GRANTED

Numerous Romero motions where Campion has successfully convinced a judge to dismiss a “strike” at sentencing thus greatly reducing a defendant’s ultimate sentence.

 

SEIZED PROPERTY BY LAW ENFORCEMENT RETURNED TO CLIENT

Numerous times successfully petitioning the arresting agency/court to return money and/or property seized by the police such as the following cases:

 

$5,500 SEIZED AND RETURNED

$5500 was returned to a client after the money was seized from her purse following the arrest of her boyfriend for possession for sale. (San Mateo County)

 

OVER $10,000 SEIZED AND RETURNED

Over $10,000 was returned to an auto mechanic who after closing the shop one night, hid his money in a vehicle he had repaired (don’t ask why) only to find out the next morning that the owner of the vehicle had picked up the repaired car and was then arrested shortly thereafter on a warrant. The vehicle was seized, the money discovered and seized as well, as the alleged fruits of a crime. After several months, a petition and a hearing, my client’s money was finally returned to him. (San Francisco County)

 

CLIENT CONVICTED OF ACCESSORY TO MURDER AFTER THE FACT GRANTED CERTIFICATE OF REHABILITATION & PARDON

Certificate of Rehabilitation and Pardon granted where client, as a young person years before, had been convicted of an accessory after the fact to a murder. (Contra Costa County)  

 

GUN RIGHTS RESTORED FOLLOWING UNJUST MENTAL HEALTH HEARINGS

Restoration of client’s 2nd Amendment gun rights after judge granted a motion pursuant to Welfare & Institutions Code Section 8103(g)(4), following unjust and dubious 5150 & 5250 hearings where client had not been effectively represented and a ruling was made prohibiting him from owning or possessing firearms. (Alameda County)

FELONY HIT & RUN DISMISSED

Dismissal on a felony hit & run w/ injury where defendant’s vehicle, which he had just sold the day before the incident, was involved in an accident and defense investigation discovered the real perpetrator of the crime. (San Francisco County)

 

DIVERSION & DISMISSAL ON VEHICLE CHARGES

Diversion and dismissal on multiple misdemeanor charges of attempting to break into multiple vehicles and vandalism where 22-year-old college student defendant was under the influence of drugs. (Los Angeles County)

 

DIVERSION & DISMISSAL OF FELONY BURGLARY FOR JUVENILE

Diversion and dismissal for 16-year-old juvenile charged, along w two minor friends, w/ felony commercial burglary of a school. (Sonoma County)

 

NO CHARGES FILED ON JUVENILE ARRESTED FOR FELONY BURGLARY

No charges filed. Community service, restitution & dismissal for a 15-year-old arrested for felony residential burglary, along w/ other minors. Case resolved w/ juvenile probation officer before charges submitted to DA for filing. (San Francisco County)

 

FELONY BURGLARY DISMISSED

Dismissal on felony commercial burglary where defendant and co-defendant girlfriend innocently used a friend’s credit card w/ her permission although unbeknownst to them, the friend had been running a credit card scam that entrapped my client and his girlfriend. After defense investigation, exculpatory evidence for both defendants was presented to the DA, prompting case dismissal.  (Alameda County)

 

ACQUITTAL ON THEFT CHARGE

Acquittal at trial where defendant was charged with theft. (San Francisco County)

 

FELONY DRUG POSSESSION FOR SALE DISMISSED

Dismissal following a successful 1538.5 motion where the defendant was charged w/ felony possession of drugs for sale and conspiracy. (Sonoma County)

 

DUI CHARGES DISMISSED AT TRIAL

Dismissal at trial of DUI where defendant, whom defense contended had been suffering from a diabetic episode during the incident, was charged with hit and run and driving under the influence of drugs. (San Mateo County)

 

MOTION FOR EARLY TERMINATION OF DUI PROBATION AND EXPUNGEMENT SAVES UKRAINIAN CLIENT’S OPPORTUNITY FOR U.S. CITIZENSHIP

Early Termination of Probation & expungement granted on a DUI conviction where defendant, a legal immigrant from the Ukraine whose sick parents were still living in their war-torn homeland, had completed only one year of a 3-year-probation but was facing a pending deadline to become a US citizen after having successfully applied and been accepted. She desperately wanted to become a US citizen in order to petition for her sick parents to come to the US. Unfortunately, she would not be able to become a citizen if she were on probation and if she had missed that deadline, she would have had to apply all over again, a process that could take 3-5 years, leaving her parents in dire straits. Thankfully, the motion succeeded. (San Mateo County)

 

FELONY GUN RELATED CHARGES DISMISSED

Dismissal of two felony charges of being a felon in possession of ammunition where defendant had not reduced a prior eligible felony conviction pursuant to Prop 47 and was thus still considered to be a felon when the police discovered ammunition in his possession during a traffic stop. They also discovered a large amount of marijuana. Through the subsequent filing and granting of the Prop 47 motion and persistent negotiation, Campion successfully had the two serious felony charges dismissed although the defendant did plead no contest to misdemeanor possession of marijuana for sale charge. (Sonoma County)

 

FELONY THEFT CHARGES AGAINST EMERGENCY ROOM NURSE DISMISSED

Dismissed felony charges against an emergency room nurse charged with stealing a patient’s medication after extensive defense investigation and aggressive discovery motions compelled the prosecution to reconsider. (Sacramento County)

WIFE STABS HUSBAND WITH A MACHETE

Negotiated a felony domestic violence disposition w/ no jail time and no strike where female defendant, mother of two young children, was arrested for attempted murder after using a machete to cut and severely injure her husband’s arm during a fight, charged w felony domestic violence w/great bodily injury and offered a 3-year prison top during initial discussions w/ the DA. Defense investigation discovered and provided mitigating evidence that convinced the sentencing judge to show justified leniency and mercy in his punishment. (San Mateo County)

 

CHARGES NOT FILED IN POSSESSION OF STOLEN ART CASE

Charges not filed on a case where client/suspect was found to be in possession of numerous highly valuable art pieces that had been reported stolen. Campion worked with client and the police agencies in facilitating not only an interview with client, counsel and police investigator but also in returning the stolen items and providing exculpatory evidence on client’s behalf to prosecuting agencies.
